The alleged Nintendo Switch modder who refused to shut down their business despite a warning from Mario maker Nintendo now appears to be taking the titan on in court without a lawyer.

As reported by Torrent Freak, Ryan Daly, the alleged owner of modding company Modded Hardware, has denied any wrongdoing in court — even that he owns and operates the business at all. Nintendo filed a lawsuit against Modded Hardware in July, alleging it "not only offers the hardware and firmware to create and play pirated games" but also provides "customers with copies of pirated Nintendo games."

"Typically, when a customer purchases a hacked console or the circumvention services, Defendant preinstalls on the console a portfolio of ready-to-play pirated games, including some of Nintendo's most popular titles such as its Super Mario, The Legend of Zelda, and Metroid games," Nintendo's lawsuit claimed.

"Indeed, because pirated Nintendo Switch games cannot be used or created without a hacked console and related software and hardware, it is only because of products and services such as those sold by Defendant that illegal marketplaces distributing pirated games exist and thrive."

He's either right and they're full of shit, because they made some big claims they'll have to prove in court (like giving out pirated games)

Dude was selling roms, he probably couldn't find anyone dumb enough to represent him. He should of cashed out and go retire in the jungle in some 3rd world country.

Yup, that was my first thought. Has nothing left to lose so fuck it; waste everyone's time and make Nintendo burn some money on lawyers dealing with this shit. Because they still have to take it seriously and do it right.

So that's why the Switch 2 reveal never happens? Nintendo is too fucking busy with all these lawsuits going around.
 
Looking at the arguments thrown around by all parties throughout the FTC trial regarding the ABK acquisition by Microsoft, this average gamer is likely to know his shit regarding the videogame industry a thousand times better and make more solid points than the entire staff of the most elite law firms in the world.
 
Even disregarding this case, Nintendo somehow needs to lose or every win will embolden them. They've managed to close the popular emulators despite them being legal by either threatening to bury the others in court fees or bribing them and they'll keep on doing this until they lose.
