It's possible we already can use it due to randomized compatibility. If we get surf and can't teach it, then swap somebody out. Now it's much more difficult due to losing the mail on groudon.

Okay so I haven't watched since halfway through Crystal and have been periodically checking this topic since occasionally so I might not be up to date with everything but I'm curious, has the Streamer addressed what he's going to do after this yet? Since everything after this could cause legal trouble.

Streamer hasn't said anything about post-HG yet. Presumably we're moving onto BW followed by BW2. We all thought gen 4 games would lead to legal trouble too, but so far not a peep from Nintendo/Gamefreak/The Pokemon Company. Streamer has said that they'd be unable to do gen 6 games though, presumably because they don't want to spend the money to get TPP working on a 3DS.
One channel has already proved it's already possible to connect the TPP input system to a real 3DS though; there was a TPP XY stream up for about a week during Platinum, with wi-fi enabled and everything. They only had about 30 viewers on average, but didn't get into any legal trouble as far as I know.
And get another Vileplume? No thanks, but I'll consider Gloom if we can get a Belossom. Also I'm pretty sure there should be a "wait for random phone call from Gina which could happen at ANY point" in between step 1 and 2.
