Actually it is. The two party system is the natural result of the first past the post system that it sets up.

Especially regarding with the Presidental election that requires a majority and not a plurality of the electoral college. A third party is just a siphon to the party that it closest resembles and let's it's opposite win.

That's not the problem, though.

It will always be a two party system unless the country drastically changes to a parliamentary system. First Past The Post voting brings with it inherent incompatibility with more than two parties.

The third party will syphon votes away from the party that it most closely resembles, leaving the most undesirable party to win, which of course is a bad outcome for both the third party voters and the voters for the party that more closely resembles the third party.

Yes it does. The basic rules of the Electoral College are laid out in Article 2 section 1. Importantly, in the 12th Amendment it is stated that

"The person having the greatest Number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President."

The bolded part is key. Someone has to win over half of the Electors to win the Presidency. If that does not happen, then the House of Representatives picks the winner from the top 3 vote getters. If you have a system that requires someone to win a majority to be elected, you have created a two party system. You simply can't have sustainable 3 or 4 way races under such rules.

If you want more parties at the Presidential level, you need to amend the Constitution. Period.

They may not need to prove anything depending on the terms. By default, most employees in this country are employees at will - meaning they can be fired without any reason at all, as long as it isn't due to an illegal discriminatory animus.
