Itch.io nuked by over excited AI "DMCA protection" bot BrandShield. No seriously

Good thing is Itch.io is back...bad thing is a company called Brand Shield, a similar AI backed "DMCA and copyright protection algorithm" ala Mark Monitor that Nintendo used earlier this year to start automating take down / DMCA requests. Granted this was just an overactive AI freaking out and a domain registrar kicking a site off the internet...but welcome to the future of AI SkyNet and "DMCA protection" that we have seen a BIT in 2024 and will be used even MORE in 2025!

My only hope is that this happens so much and so badly at the beginning that proper laws and limits to AI regulation gets put in place EARLY.

Truthfully I'd love to see a more fair and balanced take at DMCA considering so much has changed since its establishment, but I'm also worried that greedy fuck companies like Nintendo and Disney would only make it worse with their lobbying funds.

Pretty sure EU AI Act demands a Human-in-the-loop/human oversight when AI is involved.
Itch.io and anyone else hit by automated takedowns should bring the case there, even if they are are US based. You just need EU users and customers experiencing negative consequences. For example, many US news site block EU countries so they don't have to answer to EU law.

That's great news to hear about the EU. I love the personal rights/protections that the EU offers. Very ahead of the curve.

If AI takedowns are left as is, even legitimate sites with good practices won't be able to survive just a neverending waves of takedown requests regardless of validity. I think a good first step would be severe financial punitive action to every false/unsubstantiated claim. Nothing will motivate people to curtail their over-zealous use of AI like huge financial losses.

Problem again though is getting politicians to vote against their lobbying funds to get something like that passed. (EU notwithstanding)

There needs to be a “human last touch” before AI issues these takedowns. Or else it’s going to be a mess

But if it does become a mess it’ll end up regulated and that’s what it needs

Future might no similar to skynet future, but the damage in terms of like this, will surely annoying in the future. Like mini proxy war for people who own the budget to do so. And whoever wins, we lose...

Frivolous litigation via AI, proper dystopian future.
Clearly the solution is for Itch to have its own AI to fight against the AI takedown requests.

AI fighting everywhere, then they start taking over some drones for more forceful take down requests. It all ends in thermonuclear annihilation.

And all over some dumb DMCA request. But for that short wonderful time, a lot of value was created for the shareholders! 😉
